In this case study, we are going to look at the case of Miss M, who suffered serious injuries, including a spinal fracture when she was in the care of others. Miss M suffers from severe psychiatric problems, which included a tendency to self harm and was being treated in a psychiatric hospital at the time of her injury. Miss M, was suffering a psychotic episode at the time of her injury, where she was potentially a danger to herself. Despite this, she was allowed to jump out of a 4th floor window.
What Injuries Were Sustained in this Case?
As you can imagine, Miss M sustained very serious injuries as a result of her fall. These included: fracturing both feet, several fractured ribs, a punctured lung, which led to a chest infection and a fractured spine. As a result of the spinal fracture the victim suffered partial paralysis of her legs and lost control of her bladder. Within three months, the partial paralysis began to ease, as a result of using a back brace. However the incontinence did not improve and she had to be fitted with a catheter. An expert assessment concluded that this would be permanent and that Miss M would also suffer from ongoing spinal pain for the rest of her life.
The Allegation And The Compensation Award
As you can imagine, Miss M’s existing psychiatric condition made her injuries all the more distressing and this compensation claim case all the more sensitive. Fortunately, rather than having the compensation claim proceed to court, the legal team representing the Defendant agreed to work amicably with the Claimant’s legal team, to come to a fractured spine settlement out of court. The Claimant was awarded half the amount for pain, suffering and loss of amenity. She was also compensated a further award for loss of income, as a result of her injuries, leading to an overall payment of £200,000 for Miss M. Fortunately the Claimant was judged to have the mental capacity to understand the settlement so the claim did not need to proceed to court.
