Take a look at the graph above. You will see that fatal airline accidents are actually very rare. It works out that only around 1 in 3,000,000 passengers die in a fatal plane accident. This makes flying the safest mode of transport by far. In comparison, on UK roads, around 1 in every 18,000 drivers or passengers are killed each year. Your Passenger Rights When You Fly

You have very specific rights as an airline passenger that your personal injury lawyer will make use of to get you the compensation that you are entitled to. Every airline has to provide these rights to their passengers, even when outside of any airspace where legal jurisdiction exists (more on this below). Every airline gives you the following rights:

  1. You are automatically entitled to claim for personal injuries, and fatalities. There is a standard compensation structure in place to facilitate this.
  2. If you are injured and an airline is liable, then they must provide you with an advanced payment to cover any exceptional expenses, before the claim is fully settled.
  3. You must be compensated for flight delays. The length of the delay that warrants compensation is dependent upon circumstances.
  4. You must be compensated for lost or damaged luggage, once you have informed the airline in writing of the problem.
  5. You must be provided with a copy of your rights in writing. Usually, this is done in the small print of your booking confirmation.

Unexpected Turbulence Leading To Injury

When a passenger is injured in an accident that was caused by in-air turbulence, the ability to make airline accident claims will depend on whether the airline contributed to the accident in some way. If a passenger is, for example, standing in the aisle and turbulence hits, which in turn, causes them to fall and hurt themselves, then this would be considered an “Act of God”. The airline cannot be held responsible for the weather, and the passenger had chosen to stand up at that time.
