A Guide To Claims For An Allergic Reaction After Eating In All Bar One

Allergic reaction after eating All Bar One food claims guideWhether you’ve popped into All Bar One for Happy Hour, or you’re there for a special meal, you would expect that if you have food allergies, you would be able to order something without allergens in it.

All Bar One has an extensive menu, and among its dishes are those that may contain allergens. It is All Bar One’s responsibility to communicate the presence of certain allergens to its customers so they could avoid an allergic reaction after eating their dishes.

However, if they do not carefully communicate such allergens to customers on their menu, practice poor hygiene standards leading to cross-contamination, or ignore a request for an allergen-free meal, you may be able to make a claim if you go on to suffer a harmful reaction.

This guide sets out answers to some of the questions you may be asking if you’ve had an allergic reaction after eating in All Bar One. We offer a wealth of information on allergy symptoms and offer guidance on when a restaurant may have breached a duty of care it has towards you.

We also offer information on how a solicitor could help you make a No Win No Fee claim, and how Legal Expert could get the process started for you.

What Are All Bar One Allergic Reactions?

An allergic reaction to food could happen if your body sees something you’ve consumed as a threat.

Food allergies are different to food intolerances as they are due to the immune system’s response to a perceived threat, rather than the body’s reaction to amines contained in foods.

An allergic reaction after eating in All Bar One could occur if you’ve consumed something in the restaurant that you’re allergic to, and it could present a range of symptoms.

What Are The Symptoms Of A Food Allergy?

The symptoms of a food allergy could vary, depending on the type of reaction you’ve had and its severity. You could suffer:

  • An IgE-mediated allergy (involving the protein immunoglobulin E). Symptoms could include watery eyes, swollen lips, face, body or tongue, hives, itching or tingling in the mouth, a runny nose, difficulty breathing or swallowing, feeling dizzy or faint, feeling nauseous or being sick.
  • A non-IgE-mediated allergy (not involving immunoglobulin E). Symptoms could include a painful stomach, vomiting or rashes where the skin is dry, cracked or red.
  • Mixed IgE and non-IgE reactions – You could experience a mix of symptoms of both IgE and non-IgE reactions
  • Anaphylaxis – This is a severe reaction that could be life-threatening. It involves symptoms such as a tight throat, trouble breathing, clamminess, a rapid heart rate and collapsing. Urgent medical attention should be sought if you have symptoms of anaphylaxis.

What Foods Could You Be Allergic To?

According to the IFST, there are certain allergies that cause reactions more commonly than others. If you have one of the below allergies, it could be considered one of the more common types:

  • Soy allergy
  • Peanut allergy
  • Wheat allergy
  • Cow’s milk allergy
  • Tree nut allergy
  • Fish allergy
  • Shellfish allergy
  • Egg allergy

However, you may suffer another allergy, such as:

  • Gluten allergy
  • Fruit allergy
  • Dairy allergy
  • Cereal allergy
  • Sulphur dioxide allergy
  • Mustard allergy
  • Lupin allergy
  • Celery allergy
  • Seafood allergy

Allergy testing could benefit you if you think you may have a food allergy. It could be worth looking into how local allergy services could help you with allergy diagnosis and management.

Statistics On Allergic Reactions To Foods

Food.gov.uk statistics have revealed that two million people within the UK have been diagnosed as having a food allergy.

In addition to this, 1 in 10 have coeliac disease, which equates to around 600,000 people. It was also revealed that fewer people are hospitalised each year because of foodborne diseases than they are due to food hypersensitivities.

According to Allergy UK, around 20,000 people were hospitalised due to allergic reactions in 2014, and hospital admissions for those suffering from anaphylaxis jumped 615% between 1992-2012.

How To Tell The Restaurant Or Bar You Have An Allergy

When you tell a restaurant that you have food allergies and ask them for details of what allergens are in their foods, they should be able to tell you.

They might direct you to an allergy menu, or they might inform you of which dishes you could safely consume. However, you may see an item, for example, on the All Bar One food menu you would really like to order that has an allergen contained within it. If you do, you could ask whether it could be prepared without that allergen. Requests you could make of serving staff could include:

  • No Oats
  • No Cheese
  • No Nuts
  • No Fish
  • No Tomatoes
  • No Eggs
  • No Milk
  • No Wheat

If the restaurant can’t comply with your request, they should tell you so you could order something else instead. If, however, the bespoke order is accepted and you’re served a dish containing the allergen, you could claim if you go on to suffer harm.

This might arise for a number of reasons. The serving staff may forget to pass on the request or fail to make a note of it on their order receipt. Likewise, the chefs may also forget to uphold the order.

If you’ve been impacted in such a way and can prove it was the restaurant’s fault, get in touch to learn more about your rights.

How Restaurants Should Act If You Tell Them You Have An Allergy

As we mentioned, if you request for your dish to be amended, and an allergen left out, the restaurant should advise you if it’s possible to do so.

You should always be informed if the restaurant can’t make such an amendment. If staff ignore your request or do not tell you they can’t leave out an allergen, this could cause an allergic reaction. In such cases, you could have a claim for compensation if you can prove the restaurant’s failings.

Claims could relate to your request for things like:

  • No oats
  • No cheese
  • No nuts
  • No fish
  • No tomatoes
  • No eggs
  • No milk
  • No wheat

How Negligence Could Cause An Allergic Reaction

When it comes to negligence that could cause an allergic reaction in All Bar One, it may not just be due to staff ignoring your request for an allergen to be left omitted. You could also claim if:

  • Your food has been cross-contaminated with an allergen that you’d asked not to be included. For example, frying chicken in the same pan as fish.
  • You weren’t informed about allergens within dishes served in the restaurant
  • If the chefs deviate from the menu and include ingredients not advertised

If you aren’t sure whether an allergic reaction could lead to a claim, we’d be happy to help you. If you call our team, we’ll be able to assess your case to see if you could claim.

How Am I Protected Under The Law?

The law protects customers from purchasing goods that are not as described or mis-sold, and that cause harm to customers because of this. Under the Consumer Rights Act 2015, food could be described as defective if it:

  • Contains allergens not communicated to you at all
  • Contains allergens you’ve specifically asked to be removed and the restaurant has agreed to amend the dish
  • Had been cross-contaminated when you’ve specifically asked for them not to be included in your meal

Whether you suffer an allergic reaction to something on the All Bar One Bottomless Brunch menu, or something on the All Bar One dinner menu, if it is due to the reasons above, you could have a claim if you can prove the restaurant’s failings.

Nutritional And Allergy Warning Information

Restaurants and takeaways are legally obliged to provide allergen warnings about their foods to customers. They should provide this information in written form. This could be on:

  • The All Bar One Food Menu
  • A prompt on the menu explaining where allergen information could be found
  • On the website

If you are ordering an All Bar One takeaway, distance selling rules apply. This means allergen information should be given to you before your food purchase is complete and when the food is delivered. This could be provided:

  • Orally, over the phone
  • Through a catalogue or website
  • Via the menu

If you suffer a reaction after eating in All Bar One or eating takeaway food from there due to a lack of allergen information, you could make a claim for compensation.

I Did Not Say I Have An Allergy – Can I Claim?

You might not have told All Bar One staff that you’ve got allergies before you placed your order, but this wouldn’t necessarily prevent a claim from being pursued.

If you’ve suffered an allergic reaction after eating in All Bar One because the menu didn’t list one of the below 14 allergens, All Bar One could be in breach of their legal responsibilities. You may be able to claim if you’ve suffered an allergic reaction to All Bar One foods or drinks where the following allergens weren’t communicated to you in writing:

  • Eggs
  • Milk
  • Molluscs
  • Sulphites/Sulphur dioxide
  • Sesame
  • Crustaceans
  • Cereals containing gluten
  • Soybeans
  • Celery
  • Lupin
  • Tree nuts
  • Mustard
  • Peanuts
  • Fish

  • Travel expenses
  • Medical expenses
  • Care costs

To claim for these expenses, which are known as special damages, you’d have to be able to evidence them.

Receipts and bank statements could all be very useful in helping you do so. It may be a good idea to keep these in a safe place, so you could provide them to your solicitor.

How Specialist Solicitors Could Help You

It could be possible for a claimant to make a claim for an allergic reaction after eating in All Bar One without the need for legal support. However, to make a claim successfully, you would have to prove that the restaurant had a duty of care towards you and that they had breached this duty.

You’d also have to make sure you could prove that the restaurant’s breach of duty had caused you injury/illness. Legal action would also have to be taken before the personal injury claims time limit for your case had passed.

This could represent a lot of paperwork. You’d need to gather the relevant evidence and present a strong case for compensation. This is why many claimants prefer to have professional legal support besides them when making a claim for compensation.

A personal injury solicitor would have the capability to gather the relevant evidence for a personal injury claim and could build a strong case for the liable party to answer. They could also help to negotiate the maximum settlement for your claim, ensuring you don’t miss out on any compensation you could have been eligible for.

Not only this, but if your case was disputed, a solicitor could help to support you at court, and fight for the compensation that you deserve.

Here at Legal Expert, we could provide you with a solicitor for your All Bar One allergy claim if you’d like to benefit from legal support. Why not check out our reviews? We’d be delighted to help you.
