When making a compensation claim, it’s important to be aware of how a potential settlement is calculated. Not all case types we can help with and that are described above are calculated in this way, only personal injury claims and medical negligence, though similar considerations are made in other cases.
- First, your solicitor will look at your physical and psychological injuries to determine how severe they are and whether or not you’ll recover. The more severe and permanent the injury, the higher the payout
- Next, your solicitor will look at the financial impact the injury has had. In some serious injury claims, for example, you might be left with life-changing injuries that mean you cannot work again. It’s possible to get compensated for these effects.

Is There A Time Limit To Make A Compensation Claim?
There is a time limit when it comes to making a compensation claim. These time limits differ for each case, but as a quick summary:
- For personal injury claims, you have 3 years from the date of the accident to claim compensation
- In medical negligence claims, you have 3 years from the date of the negligent incident or the date you gained knowledge of it
- Criminal injury claims are subject to a time limit of 2 years from the date the crime is reported to the police
- Data breach claims enjoy a 6-year limitation period
- If you’re under the age of 18, the time limit does not begin to run until you turn 18.
It’s always important to double-check how long you have to claim. If you leave it too late, you may become time-barred, meaning you can’t claim at all.

Will my claim go to court?
It’s unlikely that your compensation claim will go to court. The industry standard is around 5%, meaning you have about a 95% chance of the claim not reaching a court room.
