Car Accident Claims – FAQs

By Lewis Coabin. Last Updated 24th July 2023. A popular car accident FAQ that our advisors get asked is regarding the time limit to start a road traffic accident claim.

The Limitation Act 1980 states that you will generally have three years from the date of injury to begin your personal injury claim. However, there are some exceptions that apply to this limitation period.

For example, if a minor has been injured in a car accident, the time limit will be frozen until their 18th birthday. From this date, they will have until their 21st birthday to begin a claim. Alternatively, while the time limit is paused, a litigation friend could make a claim on their behalf.

The limit is frozen indefinitely for those who lack the mental capacity to make their own claim. Again, during this time, a litigation friend could act on their behalf. However, should they regain this mental capacity, they will have three years from the date of recovery to begin a claim if one was not already made for them.

Can I Make A Car Accident Claim On A No Win No Fee Basis?

If you have been injured in a car accident due to another road user breaching their duty of care, you may be eligible to make a road traffic accident claim. If you contact our advisors today to discuss your potential claim, they may connect you with one of our solicitors if it seems like you have a valid case.

Furthermore, one of our solicitors may offer to work on your claim on a No Win No Fee basis under a Conditional Fee Agreement. Under this arrangement, you will not be required to pay your solicitor any service fees upfront or while your claim is processing. You will also not be obligated to pay them for their services if your claim is unsuccessful.

However, should they succeed with your car accident compensation claim, you will pay them a success fee. This fee is taken from your compensation payout. There is a legal cap in place for the percentage that your solicitor can take as this fee.

To see if you could be eligible to work with one of our No Win No Fee solicitors, you can contact our advisors today. Additionally, they can answer any questions that this car accident FAQ guide may have not covered.
