The Limitation Act 1980 states that you will generally have three years from the date of injury to begin your personal injury claim. However, there are some exceptions that apply to this limitation period.
For example, if a minor has been injured in a car accident, the time limit will be frozen until their 18th birthday. From this date, they will have until their 21st birthday to begin a claim. Alternatively, while the time limit is paused, a litigation friend could make a claim on their behalf.
The limit is frozen indefinitely for those who lack the mental capacity to make their own claim. Again, during this time, a litigation friend could act on their behalf. However, should they regain this mental capacity, they will have three years from the date of recovery to begin a claim if one was not already made for them.
