In this case study, we are going to look at the case of Mr L (we have abbreviated his name to protect his privacy), who suffered a moderate back injury at work, when he was employed by a  Council. The accident happened when a backrest on a chair that he was sitting on collapsed, causing him to fall backward. On impact, the broken spine of the chair hit his spine, causing his moderate back injury.

Accidents at Work Statistics

Between 2015-6 there were over 621,000 non-fatal injuries resulting from accidents at work. The most common of these injuries were in order of size: slips trips and falls, musculoskeletal injuries, workers being hit by falling objects, RSI (repetitive strain injury), collisions and crashes, lacerations/cuts, inhaling toxic fumes, loud noise, workers walking into objects and lastly (and quite surprisingly) fights at work. Employers are responsible for providing a safe working environment for their employees. This can be achieved by conducting regular risk assessments and identifying hazards, i.e. objects or processes that may cause employees and other stakeholders to have accidents. They are then supposed to implement control measures, meaning accidents to reduce or mitigate this risk. A simple risk assessment at a local Council could have identified this chair as faulty and therefore Mr L’s accident could have been avoided.

Details of the Moderate Back Injury

moderate back injury As a result of his accident at work, Mr L suffered a moderate back injury. At first he “didn’t appreciate how serious it (the accident) was” and went home to rest. He had pins and needles in his work and as a result of the accident was unable to walk for 3 months or return to work for 6 months. Almost 2 years later he was diagnosed with a condition called mechanical back, following an MRI scan. Although Mr L was eventually able to return to work, his quality of life was affected by his injury. He had to take strong painkillers as part of his back injury treatment, to cope with the ongoing pain from his injury. As a result of his back injury symptoms, he realised he may have to find a job which involves less manual handling.

The Back Injury Claim and Settlement

Mr L decided to sue a Council for a back injury compensation claim amount that would compensate him for the pain he had endured, the cost of his back injury treatment and loss of income. He hired an expert personal solicitor to represent him and was also supported by a representative from Unison. He was awarded £40,000 for his moderate back injury. This back injury compensation payout amount took into account the loss of income that Mr L had experienced and the fact that he may need to look for a new role.
