The Consumer Protection Act 1987 states that manufacturers can be held liable for any injuries, loss or damage, as experienced by a consumer, due to a defective product. McDonald’s manufactures and pre-packs their food products, therefore this law applies to them.
As we have already discussed, manufacturers are supposed to label any allergenic ingredients that appear on their foods. Similarly, if the food may contain traces of an allergenic ingredient (for example, the food is prepared in the same factory as products that contain nuts), there should also be a warning on the packaging as well. Packaging that does not have adequate warnings about the risk to allergy sufferers could be counted as a defective product. Failure To Warn Customers Of Allergies
