This legislation can place liability on a holiday company for negligence, even if the negligence was caused by a supplier of theirs based abroad.

However, in most cases of an accident or illness (such as food poisoning), the Montreal Convention would be applicable.

Bodily Injuries And The Montreal Convention

The Montreal Convention governs most flights between international airports. This sets out a strict system of liability. For example, a passenger injured in Jet2 flight just needs to show that the accident happened and that the convention is applicable to their case.

To claim for injuries under this, the accident needs to have been ‘unusual and unexpected’. Something such as DVT would not fall under this. The convention does not apply to domestic flights between UK airports. However, UK law allows you to claim for injuries in these cases.

There is though a first tier of airline liability in which the airline can not content a compensation claim.
