However, as we have seen with a number of tourists visiting Morocco in 2018, sickness and injury do happen in even in high quality resort destinations. When booking a holiday in Morocco, or any other destination, you should make sure that the provider is fully accredited. This should also be the case when booking activities for your holiday. You should also make sure that you have up to date travel insurance which is adequate to cover any problems you may have on your trip.

Whilst for most people, taking a city break to Marrakech, a beach holiday, golfing trip, or even a cruise, should and will be a memorable experience for all the right reasons, for some it will not. Common problems which holidaymakers to Morocco can have include sickness and food poisoning, road traffic accidents, and accidents whilst participating in activities. If your injury or sickness was caused by another party, the team at Legal Expert could help you to make a Moroccan holiday compensation claim. You can find our contact details towards the bottom of this guide in the ‘start your claim’ section.

Holiday Accident Claims In Morocco

Making holiday accident claims in Morocco

Over the last three decades, Morocco has become one of the most popular tourist destinations for British holidaymakers with 650,000 of us visiting the North African country each year. Morocco is as famous for its desserts as it is for beautiful beaches and thriving cities. Morocco is popular with British tourists as there is sunshine almost year round. There are also many UK based holiday companies offering all-inclusive holidays at competitive prices. However, for some of those tourists and visitors, the experience will not be a relaxing or happy one, suffering preventable injury or sickness if better precautions had been taken. Whilst we should note that Morocco has done much in recent years to improve hygiene standards at its resorts, standards at some are still much lower than may be expected. Illness caused by poorly prepared foods, or swimming pools which have not been cleaned properly can happen. In the most extreme instances, people have had to seek costly treatment in hospitals in Morocco.

Whilst instances are rare, we should also note that Morocco is still listed at risk of terrorism and even kidnapping in some parts of the country. According to advice produced by the UK Government for tourists visiting Morocco in 2018, the risks of these to British nationals are higher than in some other places. It is recommended that people remain vigilant at all times, though tourist resorts are generally very safe.

What to do if you have an accident or injury in Morocco

If you think that you can claim for illness on a package holiday in Morocco, or on a holiday booked independently, there are steps which you should take as early as possible. Even if you do not know whether or not you will be able to make a compensation claim, you should make sure that you get any treatment required. Your next step should be to note down who is liable for what happened to you, the circumstances of your accident, injury, or sickness. Morocco sickness claims can require the necessary evidence of being sick and how it was caused. Legal Expert have produced several guides on how to make compensation claims for accidents and injuries when outside of the UK. You find information on claiming compensation for a package holiday in this guide. You can also find other relevant information about making a personal injury claim outside the UK in this guide.

Food poisoning and sickness in Morocco

One of the most common ways in which people are harmed when on holiday abroad is through food poisoning or similar forms of sickness. There have been notable cases of food poisoning in Morocco where people have won thousands of pounds in compensation for the effect that this has had upon them and their holiday. Through 2018, there were a high number of reports of holidaymakers suffering from food poisoning whilst in Morocco. Common causes of food poisoning abroad could include;

  • Lower standards of food hygiene and food preparation,
  • Fresh and older foods being mixed together in buffets.
  • Food not being adequately stored, whether before the food has been prepared, or after being cooked.
  • Food being improperly prepared or undercooked.
  • Drinking no bottled water. It is recommended that visitors to Morocco only drink bottled or boiled waters.

The effects of food poisoning can include diarrhoea and vomiting and the symptoms of it can last for several days. The symptoms of food poisoning will spoil the remainder of your holiday. If you have experienced food poisoning in Morocco, you should visit a GP when you return to the UK. They may be able to collect supporting evidence such as stool samples. If your food poisoning happened in a hotel or hotel restaurant booked through a UK tour operator, or as part of a package holiday we can help you to pursue a claim against them in the UK courts.

Trips, and falls on holiday in Morocco

Tripping or falling over can seem an innocuous accident to have. However, slipping over, whether at the airport whilst disembarking your aircraft, or when walking down a flight of stairs in a hotel, can lead to serious injuries. If you are staying at a resort, you could even find that you are injured when slipping over at the swimming pool. Common form of injury from tripping over can include bone fractures and severely strained or sprained muscles. Any of these consequences could easily take weeks or months to recovery from, leaving you unable to fully enjoy your holiday. If you have been hurt as a result of slipping over, contact our team to find out if you can make a Morocco holiday injury claim with Legal Expert.

Car crashes and accidents on the road in Morocco

As may be expected, there are many more road traffic accidents in Morocco and as such, more people are injured in car crashes in Morocco than in the UK. if we compare figures for the year where both the UK and Morocco have available statistics, we can see that in the UK there were 1,793 deaths in road traffic accidents. Over the same period (2017) there were 3,499 deaths on the roads in Morocco. Overall in 2017, there were a total of 89,998 road traffic accidents in Morocco. Overall, Morocco does have a very poor road safety record and the UK Government recommends that drivers be much more cautious than in the UK. You can find road safety advice in the safety section of the FCO guide to Morocco. The guide does highlight potential hazards such as driving at night, in poor weather, or on secondary roads. It also highlights that even when driving at speed on motorways, you may encounter pedestrians crossing the road.

If you are involved in a road traffic accident in Morocco, you will need to fill in a ‘Constat Amiable’ form. This has to be signed by you and any other parties. You can get this form when entering Tangier by car at the port. Find more information on road safety in Morocco in this guide.

Will using a solicitor in the UK affect my claim?

When it comes to making holiday accident claims in Morocco, or indeed for any other destination outside the UK a common concern which our clients often have is whether using a solicitor based in the UK will affect the outcome of their claim. The simplest answer to this is that the location of your solicitor will not have a bearing on their ability to conduct your claim. If you live in the UK you can use a Personal injury solicitor or lawyer in the UK to make your claim. If the claim does need to be brought in the country where your accident happened, we can also organise this.

What this will mean for you as a claimant is that your personal injury claim can be made without you needing to worry about problems such as keeping in contact with a solicitor or lawyer outside of the UK, or having a difficulty with the language gap. If your injury or illness happened as part of a package holiday, being injured at a hotel or restaurant which was part of the package deal, your claim can be brought against them in the UK.

No win no fee Moroccan travel accident claims

Even in circumstances in which you have been harmed or make sick whilst on holiday as a result of negligence on the part of your holiday operator or other service provider, people can still be reluctant to take legal action against them. There is often the idea that making a claim for illness on a package holiday in Morocco or other similar action can be costly in terms of time and money. If a holiday which you have saved up for turns out a negative experience, you could be reluctant to meet those costs, even if it means holding the party to account and being compensated. For many people returning from a holiday, legal costs could prohibit them from being able to make a claim, if they needed to pay fees at the beginning of the process. This is where using the services of a no win no fee solicitor can help. These costs did used to stop people from accessing personal injury lawyers services. Today, this does not have to be the case.

No win no fee solicitors operate in a different way. Rather than asking for you to pay any fees when you begin a claim or to cover legal expenses during the process, the solicitor or lawyer will take any risk and meet any costs themselves at the time necessary. Under this type of agreement, claimants only need to pay for these services when their damages are awarded to them. Combined with our comprehensive services, this means that making a holiday accident claim in Morocco with our team will not cost you time in doing so, nor any money till you have the compensation funds to pay it from. With our conditional fee agreements, if you do not receive any compensation, you will not have any charges to pay the solicitor. Find out more about no win no fee services on this page.
